Welcome to the KANM Website ("Website"). These Terms of Service ("TOS") form a legally binding contract between you ("User") and KANM Student Radio ("Company," "we," "us," "our'') regarding your use of our online platform. Please review these TOS carefully. If you disagree with these terms, you should not use our platform.
By accessing or using this website, you represent and warrant that you have read, understood, and agreed to abide by these TOS. These TOS embody the entire understanding between us and override any previous or concurrent agreements, whether oral, written, or in any other form, pertaining to the subject matter of these TOS.
Subject to your agreement and ongoing compliance with these TOS, we grant you a limited, non-exclusive, non-transferable, and non-sub-licensable license to use this website for personal or business purposes. All rights, title, and interests in the software, including all associated intellectual property rights, belong to KANM Student Radio and/or its licensors. This license does not imply any ownership or transfer of rights in the software.
By using this website the user agrees to comply with all applicable laws and policies governing the use of Texas information resources.You shall not reverse-engineer, decompile, disassemble, or attempt to discover the source code of our software, nor create derivative works from our software or use our platform for illegal or unethical activities. Unauthorized use of the platform may subject you to civil and/or criminal penalties, including potential financial damages. Usage may be subject to security testing and monitoring. By uploading, transmitting, or submitting any data, text, images, or other materials to this website ("User Content"), you agree to grant KANM Student Radio a perpetual, irrevocable, worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display such User Content (in whole or part) and/or to incorporate it in other works in any form, media, or technology now known or later developed. This grant includes the right for us to make the User Content available to other companies, organizations, or individuals who partner with us for the syndication, broadcast, distribution, or publication of the User Content on other media and services. You represent and warrant that you own or have the necessary licenses, rights, consents, and permissions to grant these rights to us.
You acknowledge and agree that any User Content that includes materials for which you have obtained a license for use remains subject to the terms of those licenses. By submitting such User Content, you affirm that you have secured all necessary permissions and rights to permit us to use the licensed materials as part of your User Content under these ToS. You are solely responsible for ensuring that the use of such licensed materials through us, by virtue of being included in your User Content, complies with any applicable licenses and does not infringe upon any third-party rights, including but not limited to intellectual property rights.
We reserve the right, but do not assume the obligation, to review User Content to determine whether it violates any legal rights of any party or these ToS. Upon identifying any User Content that infringes upon the copyright or rights of any person, entity, or the terms provided herein, we may edit, refuse to post, or remove the infringing content at its sole discretion, without prior notice. Users found to be repeatedly infringing copyright or other intellectual property rights of others may face termination of their account and further legal action.
